Advice on Discrimination Claims
If an employee considers that they have been discriminated against in the workplace they may pursue a claim in Employment Tribunal. If an employee is successful in their claim, a Tribunal may award compensation. Unlike unfair dismissal claims, there is no statutory cap on the amount of compensation a Tribunal may award in respect to a discrimination claim. A Tribunal may award what they consider to be just and equitable having regard to the circumstances of the case.
Compensation may be awarded for loss of earnings and injury to feelings. Employees may pursue discrimination claims whilst they remain in employment. The time limit for pursuing discrimination claims is usually within three months of the act of discrimination.
If you consider that you have been discriminated against in the workplace, we can advise you on the merits of your claim, assist you in raising a statutory grievance to complain about the discrimination and if appropriate, pursue a discrimination claim on your behalf at an Employment Tribunal.
