Legislation prohibiting unlawful discrimination in the workplace has developed significantly. It is currently unlawful to discriminate against employees or workers on the grounds of:

  • Race
  • Gender
  • Disability
  • Sexual Orientation
  • Religion and Belief
  • Age
  • Gender Reassignment
  • Marital or Civil Partnership Status.

Unlawful discrimination can occur in all aspects of the employment relationship including; job advertisements, selection for interview, selection for promotion, whilst dealing with grievance or disciplinary issues and when dismissing and retiring employees.

In contrast to unfair dismissal claims, there is no statutory cap on the amount of compensation that an Employment Tribunal may award in cases where an employee is successful in a discrimination claim.
