Non-Molestation Order
The court can grant an order prohibiting the other party, known as the Respondent from molesting you or a child. The word molestation covers not only violence and threats of violence but also pestering. Thus, such an order could be granted against a Respondent who sends abusive letters or who persistently telephones his (former) partner in the middle of the night.
The court must have regard to all circumstances of the case when deciding whether to make an order, including the need to secure yours and your children’s health, safety and well being. Provided you can show a genuine need for protection a non-molestation order will be granted.
The order may be made for a specified period or until a further order. Therefore an order may be for an indefinite period.
