This is an order for regular payments designed to tide a spouse over until the divorce is determined.
Periodical Payments
Periodical payments usually take the form of weekly or monthly sums and will terminate on the death or remarriage of the recipient, however it is unaffected by the remarriage of the payer unless an application is made by the payer to discharge or reduce the payments.
Secured Periodical Payments
This takes effect by charging an asset with a sum fixed by the court from which the periodical payments can be met. It ensures that the recipient will continue to receive the periodical payments even if the payer’s income fluctuates or if problems of enforcement are anticipated.
