Detention and bail

Any detainee has a right to legal representation. Such person has a right to choose his own legal representative. It is therefore not necessary for you to accept the legal representative or immigration solicitor that is arranged by the Home Office at the Detention Centre. Most detention cases are for the purpose of removal and, therefore, it is important that you choose your legal representative carefully if you wish to challenge the Home Office’s decision to remove you from the UK. In many cases, due to physical restrictions, it may be advisable for you to contact your friends and family in the UK immediately, who can assist you in finding a legal representative or immigration solicitor to represent you and to assist you in preparing the necessary supporting documents if you are to challenge the Home Office’s decision to remove you.

In some cases, you may be able to obtain bail either directly from the Home Office or from the Asylum and Immigration Tribunal. An experienced legal representation or immigration solicitor will be able to advise you of your options and course of action.
